1. About these terms
These terms govern your use of vintari.com.au and any purchase from, or sale to, Vintari Pty Ltd (ABN 48 657 836 729), trading as Vintari Gold Brokers (“Vintari”, “we”, “us”), of 889 South Road, Clarence Gardens SA 5039. They apply to dealings online, in our store, by telephone and through our mail-in service.
By placing an order, or by selling to us, you accept these terms. Please read section 6, which sets out our Market Loss Policy, because it affects what you owe us if an order is not completed.
Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded.
2. Who can deal with us
You must be at least 18 years of age and able to enter a binding contract. We deliver to addresses within Australia only and do not ship internationally. We may decline or cancel any order or purchase, including where we cannot verify your identity, where we suspect fraud, or where an item has been listed at a manifestly incorrect price.
3. Online orders and pricing
Prices for bullion move continuously with the market. A price shown on this website is an invitation to buy at that price at that moment and is not held open.
Your order is confirmed, and the price locked, when you place it at checkout and we issue you an order number. From that moment the price does not change for either of us: not if the market rises before you pay, and not if it falls.
We may refuse or cancel an order before confirmation. If we cancel a confirmed order for a reason that is our fault, we will refund you in full.
4. Buying bullion in store
You are welcome to buy over the counter at Clarence Gardens.
- A price quoted in store is based on the market at that moment and is held only for as long as it takes to complete that transaction. If you leave and return, the price will be whatever the market is then.
- Stock shown online is not a guarantee of stock in store, and stock held in store is not reserved until it is paid for.
- We accept the payment methods advertised in store at the time. Goods are released once payment has cleared; for payments that are not immediate, that means once funds are received.
- Identification is required for bullion transactions of $5,000 or more, whatever the payment method, as set out in section 7. Below that value we do not normally ask, subject to the exceptions in that section.
- Risk in the goods passes to you when they are handed to you. Please check your purchase before leaving the counter.
Collecting an online order in store
If you choose collection at checkout, we will tell you when your order is ready. Please bring photo identification so we can confirm we are handing your order to you. This is to protect your order and is separate from the identification rules in section 7. We may decline to release an order to anyone other than the person who placed it, and we may hold an order for collection only for a reasonable period before contacting you about it.
5. Payment
For online orders, payment is by bank transfer to the account shown on your order. Please quote the order number as the payment reference, or we may not be able to match your payment.
Payment is due promptly. We will send you reminders if your order is unpaid, and an unpaid order may be cancelled after the period stated in those reminders. Goods are not dispatched until cleared funds are received.
6. Market Loss Policy
This section is important, and it is the one we ask you to acknowledge at checkout.
When your order is confirmed, as defined in section 3, we secure the metal and our position at the price quoted to you. That price is locked at the live market price at that moment.
- Orders are final. Changes and cancellations are not accepted after confirmation.
- If you do not pay, we may cancel your order. If the market price of the metal at the time of cancellation is lower than the price locked in on your order, you remain liable to us for the difference, together with our reasonable administration costs. We will show you how the shortfall was calculated and what those costs were.
- If the market has risen, we keep the difference and nothing is payable to you. The lock protects you against a rise in exactly the same way it protects us against a fall.
- We may set off any market loss against funds we hold for you, and may recover the balance as a debt.
This policy exists because a bullion price is only meaningful if both sides are held to it. It does not affect your rights under the Australian Consumer Law, including where goods are faulty, not as described, or not delivered.
7. Identification
We are required to identify our customers in two different situations, under two different laws. Both are obligations we cannot waive.
Bullion, whether you are buying or selling
We are enrolled with AUSTRAC as a reporting entity and are subject to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). Identification is required for bullion transactions of $5,000 or more, whatever the payment method and whichever way the metal is going. Related transactions may be counted together in reaching that figure.
Below $5,000 we do not normally ask for identification on bullion. We may still be required to, and will, where the law obliges us: where we have any concern about a transaction, or where transactions appear to be structured to stay under the threshold.
In store this means sighting your identification at the counter. For online orders it is done electronically before dispatch, and an order at or above that value will not be sent until verification is complete.
We may also be required to report transactions to AUSTRAC, and may be prohibited by law from telling you when we have.
Jewellery, scrap and other second-hand goods you sell to us
Vintari is registered with South Australia Police as a second-hand dealer and pawnbroker, and must record the identity of every person it buys second-hand goods from. Identification is therefore required for all jewellery, scrap and second-hand purchases, regardless of value. There is no threshold and no minimum.
This applies in store and to our mail-in service alike. If you are not able to provide identification, we cannot buy these items from you, and for mail-in we will return them to you.
How we handle the information we collect for both purposes is set out in our Privacy Policy.
8. Delivery, risk and insurance
Orders are dispatched Australia wide by insured post or courier once cleared funds are received and any required identity verification is complete. Insurance is arranged and paid for by us, and your parcel is covered in transit until it is delivered. Delivery timeframes are estimates, not guarantees.
Risk in the goods passes to you on delivery. Deliveries may require a signature. If you ask for goods to be left unattended, or give delivery instructions that result in the goods being left without a signature, risk passes to you at that point and insurance cover may be void.
Please inspect your parcel on arrival and tell us immediately if it appears damaged, tampered with, or if the contents do not match your order.
9. Returns and refunds
Bullion is priced against a moving market, so we do not offer change-of-mind returns or refunds. This is a normal condition of trading in precious metals and is the counterpart of the price lock described in section 6.
This does not affect your rights under the Australian Consumer Law. If goods are faulty, not as described, or differ from what you ordered, you are entitled to a remedy. Contact us and we will resolve it.
10. Selling to us: scrap, jewellery and bullion
We buy gold, silver and platinum in most forms, including scrap and broken jewellery, coins, bars, silverware and dental gold. This section explains how that works, whether you come into the store or use our mail-in service.
How we assess your items
- We sort your items by metal and by purity, because a price can only be worked out per carat or per fineness. Mixed lots are separated before anything is weighed.
- We weigh on scales appropriate for trade use. Weights are recorded per purity group, and we will show you the weights we have used.
- We test to establish purity. Testing includes non-destructive electronic methods such as X-ray fluorescence, and examination of hallmarks. A hallmark is a guide, not proof, so we test regardless of what an item is stamped.
- For jewellery and scrap we sometimes also need to acid test, which marks the item, or to remove a very small quantity of material. We will tell you before we do anything that marks or alters an item, and we will not do it without your agreement. If you would rather we did not, say so, and we will either assess it another way or decline to buy it.
- Bullion is not acid tested or altered.
- We buy the metal. Stones, clasps, springs, pins and other non-precious components are excluded from the weight we pay on. We do not value gemstones, and we are not able to guarantee the return of small stones removed during processing. If an item contains a stone you want back, tell us before we assess it.
How we price it
- Our offer is based on the assessed pure metal content and our payout rate for that metal at that time.
- Payout rates move with the market and may differ between metals, and between one day and another, including at weekends when the market is closed.
- An offer made in store is based on the items as presented and is valid at that time only. If you take your items away and return later, the offer will be recalculated.
- You are free to decline. If you decline in store, your items are returned to you immediately.
- Once you accept an offer and we pay you, the sale is final and the items become ours.
Your obligations
You warrant that you own the items you sell to us, or are authorised to sell them, and that they are not stolen or subject to any other claim.
Identification is required every time we buy jewellery, scrap or other second-hand goods from you, whatever the value. As a registered second-hand dealer we must record who we bought each item from, and we keep those records as the law requires. Please bring photo identification with you; without it we cannot buy these items, however small the transaction.
Bullion is treated differently: identification is required where the transaction is $5,000 or more, and below that we do not normally ask, subject to the exceptions in section 7.
We may decline to buy any item, and we do not have to give a reason.
11. Mail-in pack
Our mail-in service lets you post items to us for assessment. The assessment and pricing in section 10 apply in the same way.
- We send you the mail-in pack. It contains free prepaid postage to send your items to us, and an information booklet explaining how the process works.
- Your parcel is insured in transit to us, and insured again on the way back to you if you decline our offer. Please pack your items securely and use the prepaid postage we supply, following the instructions in the booklet, so that cover applies.
- We will assess your items and make you an offer. The offer is based on the market at the time it is made and is open for the period stated with it.
- If you accept, we pay to the account you nominate once any required identification is complete. For jewellery, scrap and second-hand goods that means every time, whatever the value; for bullion it applies at $5,000 or more. See section 7.
- If you decline, we return your items to the address we hold for you, at our cost, by insured post.
- Because we cannot show you the assessment in person, we keep a record of the weights and purities used, and will provide them on request.
12. Loans
We provide secured loans from our store. Loans are not offered or administered through this website, and these terms do not govern them. Any loan is subject to a separate written agreement entered into in store, which sets out the amount, the fees, the term and what happens if the loan is not repaid.
13. Investment risk
We deal in physical precious metals. We are not financial advisers and nothing on this website is financial product advice, nor a recommendation to buy or sell.
The price of precious metals rises and falls. Past movements are not a guide to future movements, and you may get back less than you paid. You should consider your own circumstances and seek independent advice before investing.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.
15. This website
The content of this website, including text, images, logos and the Vintari name, belongs to us or our licensors and may not be reproduced without our permission. Prices and product information are published in good faith and may contain errors; we may correct them at any time.
You must not use this website in any way that interferes with it, or attempt to gain unauthorised access to any part of it or to any account that is not yours.
16. Liability
To the extent permitted by law, and subject always to the Australian Consumer Law, our liability to you in connection with an order or a purchase is limited to the price paid for the goods, and we are not liable for indirect or consequential loss, including loss of profit or loss of opportunity arising from movements in the metal price.
17. Events outside our control
We are not liable for failure or delay caused by events beyond our reasonable control, including carrier failure, supply interruption, banking system outages, fire, flood, industrial action, or government action. If such an event prevents us performing an order for a sustained period, either of us may cancel it and we will refund what you have paid in full. Section 6 does not apply to an order cancelled for this reason.
18. Changes to these terms
We may update these terms. The version published on this page when you place an order, or when you sell to us, is the version that applies to that transaction.
19. Governing law
These terms are governed by the laws of South Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
